1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Guest," "you," or "your") and soltiqasa ("Company," "we," "our," or "us") governing your use of our corporate housing services in Malaysia.

By booking a property, accessing our website, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use our services.

2. Definitions

  • "Property" means any residential accommodation operated or managed by soltiqasa
  • "Booking" means a reservation for accommodation at a Property
  • "Services" means all housing and related services provided by soltiqasa
  • "Minimum Stay" means the required initial occupancy period for each property type
  • "Monthly Rate" means the all-inclusive fee for property occupancy and services

3. Eligibility

You must be at least 18 years old and have legal capacity to enter into binding contracts. By using our services, you represent and warrant that you meet these requirements.

Corporate bookings may be arranged by an employer on behalf of employees. In such cases, the employer assumes responsibility for compliance with these Terms and all payment obligations.

4. Booking and Reservations

4.1 Booking Process

Bookings are confirmed upon receipt of signed booking agreement and initial payment. Property availability is subject to confirmation. We reserve the right to decline bookings at our discretion.

4.2 Minimum Stay Requirements

  • Plug-and-Work Flats: 2 weeks minimum
  • Boutique Heritage Apartments: 1 month minimum
  • Mountaintop Glass Villas: 1 month minimum

4.3 Property Assignment

We reserve the right to assign a comparable or superior property within the same category if the originally booked unit becomes unavailable due to unforeseen circumstances.

5. Payment Terms

5.1 Rates and Fees

Monthly rates are quoted in Malaysian Ringgit (RM) and include rent, utilities (within reasonable usage), furnishings, internet, and property-specific services as detailed in the booking confirmation.

5.2 Payment Schedule

First month's rent and security deposit (equivalent to one month's rent) are due before move-in. Subsequent monthly payments are due on the first day of each month. Corporate clients may arrange net 30 payment terms with approved credit.

5.3 Late Payments

Payments received after the fifth day of the month incur a late fee of RM 200. Continued non-payment may result in service suspension and tenancy termination.

5.4 Excessive Utility Usage

Utility costs exceeding 150% of average usage for similar properties will be billed separately at actual cost.

6. Cancellation and Refund Policy

6.1 Cancellation by Guest

Cancellations more than 14 days before move-in: Full refund minus RM 500 administrative fee. Cancellations 7-14 days before move-in: 50% refund of first month's rent. Cancellations less than 7 days before move-in: No refund of first month's rent.

6.2 Early Departure

After completing the minimum stay period, guests may terminate with 30 days written notice. No refunds for early departure during the minimum stay period except in cases of documented emergency.

7. Guest Responsibilities

7.1 Property Care

You agree to maintain the Property in good condition, use all fixtures and appliances responsibly, report maintenance issues promptly, and comply with building rules and local regulations.

7.2 Prohibited Activities

The following are strictly prohibited: illegal activities, excessive noise or disturbances, smoking in non-designated areas, unauthorized alterations to the Property, subletting or unauthorized guests, and activities that damage the Property or disturb neighbors.

7.3 Security and Access

You are responsible for securing access codes and keys. Lost keys or access devices will be replaced at your expense (RM 300 fee).

8. Property Maintenance and Services

8.1 Maintenance Response

We commit to addressing emergency maintenance (plumbing, electrical, security) within 24 hours and non-urgent maintenance within 48 hours during business days.

8.2 Property Inspections

We reserve the right to inspect the Property with 24 hours notice, or without notice in emergencies.

8.3 Service Modifications

We may temporarily interrupt services for maintenance or emergencies. We will provide advance notice when possible and work to minimize disruption.

9. Damage and Liability

9.1 Security Deposit

Security deposits will be returned within 14 days of departure, less deductions for damages, excessive cleaning, or unpaid charges. Documented damages will be itemized.

9.2 Guest Liability

You are liable for damages to the Property or its contents caused by you, your guests, or through negligence. Normal wear and tear is excluded.

9.3 Company Liability Limitation

We are not liable for loss or damage to your personal property, theft by third parties, or injuries occurring on the Property except where caused by our gross negligence or willful misconduct.

10. Termination

10.1 Termination by Company

We may terminate this agreement immediately for breach of Terms, non-payment after 10 days notice, illegal activities, or behavior endangering property or other residents.

10.2 Effects of Termination

Upon termination, you must vacate the Property, return all keys and access devices, and settle all outstanding charges. Failure to vacate may result in legal action.

11. Disclaimers and Warranties

Services are provided "as is." We make no warranties regarding uninterrupted service availability, specific results, or fitness for particular purposes. Property descriptions are accurate to our knowledge but minor variations may occur.

12. Limitation of Liability

Our total liability for any claims arising from or related to these Terms shall not exceed the amount paid by you for the Property during the three months preceding the claim.

We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, business interruption, or data loss.

13. Indemnification

You agree to indemnify and hold harmless soltiqasa, its employees, and contractors from claims, damages, or expenses arising from your breach of these Terms, negligence, or violations of applicable laws.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of Malaysia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia.

15. Dispute Resolution

We encourage resolution of disputes through good faith negotiation. If negotiation fails, either party may pursue remedies through Malaysian courts.

16. General Provisions

16.1 Entire Agreement

These Terms, together with your booking confirmation, constitute the entire agreement between you and soltiqasa regarding our services.

16.2 Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.

16.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

16.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations at our discretion.

17. Changes to Terms

We may modify these Terms at any time. Changes will be posted on our website with an updated "Last Updated" date. Continued use of services after changes constitutes acceptance of modified Terms.
